8. PROMOTION

8.1 FREYA RIDINGS SOCIAL MEDIA COMPETITION

1. This Promotion is open to residents of the United Kingdom aged 18 or over, excluding employees of Harvey Nichols, their families, agents or anyone else professionally connected with this promotion.

2. Promotion Period: 20th May 2019 until 23.59 on 23rd May 2019 (“Closing Date”). Any entries submitted outside these dates will not be entered into the competition.

3. Internet access and a valid public Instagram account is required.

4. To enter: During the Promotion Period, customer must be following the @harveynichols account and tag one friend in the relevant posts comments section to be in with a chance to win. Prize: 70 x winners will receive a double pass to the Freya Ridings gig at Harvey Nichols Knightsbridge on Friday May 31st at 7pm. 1 x winner will also receive a 15 minute meet and greet opportunity with Freya Ridings on the night. Winners must be a Harvey Nichols rewards member.

5. All prizes are non-transferable, non-refundable and cannot be exchanged for any cash alternatives in whole or in part. All transport and accommodation costs are the responsibility of the winner. The Promoter reserves the right to provide an alternative prize or reward (as applicable) of equal or greater value in the event of unforeseen circumstances.

6. Winner Selection: We (Harvey Nichols) will select the 70 x winners for double passes, and the 1 x winner of the meet & greet with Freya Ridings, at random on Friday 24th May 2019 from all valid entries received in accordance with these terms and conditions. Our decision is final.

7. Entries will be deemed invalid if they: include any reference to inappropriate or excessive drinking; contain defamatory, malicious, indecent or other inappropriate content; represent a danger to health and safety; promote drugs or drug culture; refer to brands other than those of the Promoter; include images of children who are not the children of the entrant; include trademarks, logos or copyrighted material not owned by the entrant or used without the right holder’s prior written permission (including famous names, company names etc.); include the names of any individual without their express permission; or in the reasonable opinion of the Promoter, cause any widespread or serious offense (taking into account prevailing community views or standards).

8. Winner Notification: Where winners permit direct communication, the winner will be notified by private message on Instagram within 1 working day of the date of the winner selection. Where the winner does not permit direct communications from the brand, the provisional winner will be announced on Harvey Nichols Food Instagram account and asked to make contact with the brand to verify their status as a winner. If a winner is not contactable or fails to respond to the initial winner notification within 24 hours of the notification, the prize may be reallocated by the Promoter. In the event of Freya Riding’s absence on 31st May, the gig and winner meet & greet will be cancelled and not held at any other time.

9. Incomplete, illegal, misdirected or late entries, or entries not in accordance with these terms and conditions will not be accepted. Proof of sending will not be accepted as proof of delivery. The Promoter takes no responsibility for entries delayed, incomplete or lost due to technical reasons or otherwise.

10. Bulk entries made from trade, consumer groups or third parties will not be accepted. Incomplete or illegible entries, bulk entries, entries by or via third parties or syndicates, entries by macros or other automated means (including systems which can be programmed to submit entries), and entries which do not satisfy the requirements of these terms and conditions in full will be disqualified and will not be counted. If it becomes apparent that a participant is using a computer(s) to circumvent this condition by, for example, the use of ‘script’, ‘brute force’, masking their identity by manipulating IP addresses, using identities other than their own or any other automated means in order to generate additional entries in a way that is not consistent with the spirit of the promotion, that person’s entries will be disqualified and any prize award will be void.

11. Winner publication: The name, winning entry and location of the confirmed winner will be available after 29th May 2019 on the Harvey Nichols Instagram account.

12. The winner agrees to take part in publicity in connection with this promotion. If the winner does not want their name to be published they should inform the Promoter when accepting their prize.

13. By entering the promotion, the entrant agrees that the Promoter has exclusive and unreserved rights to use their entries in any publicity materials.

14. Data Protection: the Promoter will only use the personal details supplied for the administration of the promotion and for no other purpose, unless we have your consent. Your personal details will at all times be kept confidential and in accordance with the Data Protection Act 1998.

15. The decision of the Promoter is final, and no correspondence will be entered into.

16. The Promoter accepts no responsibility for late, incomplete, incorrectly submitted, corrupted or misdirected entries.

17. The Promoter reserves the right in its sole discretion to disqualify any individual that corrupts or affects the administration, security, fairness, integrity or proper conduct of the promotion.

18. The Promoter cannot accept any responsibility for any damage, loss, liabilities, injury, costs, expenses or claims suffered by entrants as a result of entering the promotion or accepting a prize. The Promoter further disclaims liability for any injury or damage to you or any other person relating to or resulting from participation with this promotion.

19. If for any reason any aspect of this competition is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, the Promoter may in its sole discretion cancel, terminate, modify or suspend the competition, or invalidate any affected entries. If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions the Promoter will not be liable for any failure to perform or delay in performing its obligation.

20. If for any reason the Promotion is not capable of running as planned for reasons (including but not limited to tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion), the Promoter reserves the right (subject to any written directions given under applicable law) to disqualify any individual who tampers with the entry process and to cancel, terminate, modify or suspend the promotion.

21. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using the prize, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law.

22. Entrants agree to be bound by these Terms and Conditions.

23. Any question concerning the legal interpretation of the rules will be based on English law and the Courts of England and Wales will have exclusive jurisdiction.

8.2 SHOPPING PARTY WEEKEND

1. Rewards members can receive up to 25% off Fashion (including Shoes), 15% off Harvey Nichols own label food, wine, spirits & hampers, 15% off Beauty & 15% off Accessories when making purchases in all UK Harvey Nichols stores and online at harveynichols.com during the Shopping Party promotional period.

2. Dublin customers can shop in-store during the promotional period without membership to Rewards by Harvey Nichols.

3. The promotional period begins 10pm Thursday 16th May 2019 until Sunday 19th May 10pm (Online promotion ends 09:59am Monday 20th May).

4. Offer excludes selected brands, concessions and departments. Only products shown online, with pink pricing, are participating in the Summer Shopping Party promotion. Any products online, without pink pricing, are NOT participating in the Summer Shopping party promotion.

5. Discount cannot be used in conjunction with other discounts or offers, for the purchase of Gift Vouchers, or in selected areas including hospitality.

6. Discount is not available on Autumn/Winter 2019 stock.

1. 8.4 DOUBLE POINTS WEEKEND

1. Rewards customers are eligible to earn double points on all purchases made online and in-store from 10am on Friday 10 May to Sunday 12 May 2019 (In-store COB & Online 23:59pm)

2. Points earned in May 2019 will contribute to Rewards unlocked in September 2019.

3. In order to earn double points in-store, you must present your app at point of purchase or scan your valid receipt within 14 days from purchase.

4. Selected concessions are excluded from this promotion. For guidance on concessions please enquire in-store.

8.6 GIFT EXPERIENCES

1. Booking in advance is required. When you are ready to book your dining package, please get in touch with a member of the team at your chosen store. Find all contact details here.

2. The Gift Card number may be required to complete the booking. This number can be located on the back of the card.

3. Dining packages are not redeemable in hospitality concessions.

4. The dining insert and the Gift Card must be presented upon redemption of the gift package in-store.

5. Dining packages cannot be redeemed in conjunction with any other offer or discount.

6. Dining packages are non-refundable and cannot be exchanged for cash or other services.

7. Dining packages are valid for 24 months from the date of purchase and must be redeemed within this time.
